LANDMARK SCOTUS DECISION CONCERNING ARTICLE III STANDING

JUNE 26, 2021

In an 5-4 opinion by Justice Kavanaugh on June 25, 2021, the Court held that only a plaintiff concretely harmed by a defendant’s violation of the Fair Credit Reporting Act has Article III standing to seek damages against that private defendant in federal court. In so ruling, the Court rejected the dissent’s position (Thomas, Kagan, Breyer and Sotomayor), holding that a violation of an “individual right gives rise to an actionable harm.”
